Terms of use: ORCHA Compare

These Terms of Use (“Terms”) govern your use of the ORCHA Compare platform (the “Platform”), operated by ORCHA Health Limited (“ORCHA”, “we”, “our”, “us”). By accessing or using Compare, you agree to these Terms.

 

1. Interpretation

1.1 Capitalised terms have the meanings given in the ORCHA Standard Definitions Schedule (as updated from time to time and available at https://orchahealth.com/legal/definitions).
1.2 Compare provides access to ORCHA’s assessment data, including Assured and Assessed products, detailed App Cards, Health Areas, Support Units, and App Collections.
1.3 These Terms incorporate and supersede any previous ORCHA Compare user terms or supplemental policies.

 

2. About Compare

2.1 Compare is a digital health compliance and insight platform that enables Subscribers and authorised users to:
- search for, filter, and compare Digital Health Products;
- view detailed App Cards showing summary results of ORCHA Assessments;
- explore thematic Health Areas, Support Units, and App Collections curated by ORCHA; and
- purchase or request Compliance Reports for specific products.
2.2 Compare is designed for professional and organisational users to support digital health evaluation and adoption.
2.3 Compare is not a clinical decision-support system or a regulatory advisory tool and must not be used as such.

 

3. Assured and Assessed Products

Compare includes both ORCHA Assured Products and ORCHA Assessed Products:
- ORCHA Assured Products have been assessed by ORCHA against one or more of the ORCHA Assessment Frameworks (for example, OBR or OBR+), have achieved the applicable ORCHA Assurance Standard, and are subject to ongoing monitoring and re-assessment. ORCHA Assured Products are covered by the ORCHA Guarantee set out in these Terms.
- ORCHA Assessed Products have been assessed by ORCHA under one or more of the ORCHA Assessment Frameworks but have not achieved ORCHA Assured status and are not covered by the ORCHA Guarantee.
The classification of a product as ORCHA Assured or ORCHA Assessed reflects the outcome of ORCHA’s independent assessment of information available at the Assessment Date. It does not indicate whether the product met or failed to meet any standard, nor does it imply regulatory approval or clinical endorsement. Product listings, results, and status may change over time as new evidence becomes available or as the product itself changes.

 

4. Assessment Methodology and Evidence Interpretation

4.1 Assessments shown on Compare are based on information obtained from:
- publicly available sources reviewed at the time of assessment; and
- information provided by Developers or Suppliers, where available.
4.2 ORCHA distinguishes between:
- ORCHA Validated Evidence – information verified directly by ORCHA reviewers from public sources; and
- Developer Trusted Evidence – information supplied by the Developer or Supplier that could not be independently verified but was accepted in good faith.
4.3 A response of “No”, “Area for Improvement”, or “Impaired” means only that no publicly available evidence meeting the relevant ORCHA criteria was identified within the sources reviewed at the time of assessment. It does not mean that the product fails to meet a requirement or that the evidence does not exist elsewhere.
4.4 Assessments are point-in-time evaluations. Information may have changed since the Assessment Date.
4.5 Full details of the assessment methodology are contained in the OBR Framework Description, which forms an integral interpretive part of every report and Compare data presentation.

 

5. App Cards, Health Areas, Support Units, and App Collections

Compare displays information drawn from multiple sources, including ORCHA’s independent assessments, descriptive content created by ORCHA, and information provided directly by Developers or Suppliers.
- App Cards present factual results from ORCHA’s independent assessment of each product against the relevant ORCHA Assessment Framework(s). This includes compliance indicators and evidence-based responses such as “evidence found”, “partial evidence found”, or “no evidence found”. These outputs represent the position at the time of assessment only, based on the information and sources reviewed.
- A response of “no evidence found” or “area for improvement” means that ORCHA could not locate evidence meeting the criteria within the defined review scope; it does not mean that such evidence does not exist or that the product fails to meet the requirement.
- Health Areas, Support Units, and App Collections are curated groupings and descriptions created by ORCHA to help users navigate the platform and explore relevant digital health tools. These descriptive texts are written by ORCHA and provided for informational purposes only. They are not medical, clinical, or regulatory advice.
- Developer Descriptions appearing on App Cards are written and submitted by Developers or Suppliers. ORCHA does not verify or endorse these descriptions and is not responsible for their accuracy or completeness.
All information on Compare, including App Cards and curated groupings, is provided “as is” and “as available”. It does not constitute a certification, approval, or guarantee that a product is safe, effective, or compliant, nor does it replace your own due diligence or regulatory verification processes.

 

6. Regulatory Status and Advice Disclaimer

Compare is an informational transparency platform only. It provides factual summaries of assessment outcomes and evidence classifications.
- Compare does not provide regulatory, medical, clinical, legal, or investment advice.
- Information displayed on Compare must not be interpreted as evidence of regulatory compliance, medical-device approval, or product certification.
- You must conduct your own independent technical, regulatory, and clinical due diligence before relying on any product or making related decisions.
- ORCHA expressly disclaims responsibility for any decisions or outcomes based on Compare data, including where product changes occur before ORCHA becomes aware of them.

 

7. The ORCHA Guarantee

The ORCHA Guarantee applies only to ORCHA Assured Products and provides limited assurance that, to ORCHA’s knowledge, those products met the applicable ORCHA Assurance Standard at the time of assessment.
The Guarantee is subject to the following conditions:
(a) the Subscriber has an active Compare subscription;
(b) the Subscriber has activated and maintained the Compare Watchlist for the relevant product(s); and
(c) the Subscriber takes appropriate action in response to notifications of change in a product’s status.


The Guarantee does not cover:
- products that are ORCHA Assessed only;
- losses where a Subscriber failed to act upon ORCHA notifications; or
- changes to products that occur before ORCHA becomes aware of them.
Web applications and similar products are reassessed on a three-monthly basis unless the Supplier notifies ORCHA of a change earlier.
ORCHA’s total liability under the Guarantee is limited as described in Clause 11.

 

8. Compliance Reports

Compare Subscribers may order Compliance Reports for products listed on the Platform.
The sale and use of Compliance Reports are governed by the Verify Compliance Report Terms of Sale and Use, available at https://orchahealth.com/legal/compliance-report-terms. 
By ordering a Compliance Report through Compare, you agree to be bound by those terms.

 

9. Accuracy, Reliance, and Due Diligence

All information on Compare is provided on an “as is” and “as available” basis. ORCHA uses reasonable skill and care but does not guarantee that information will be complete, current, or error-free.
- Users must not rely on Compare as the sole source of information for procurement, regulatory, or clinical decisions.
- Compare is intended to support — not replace — professional due diligence, internal assurance, and governance processes.
- ORCHA owes no duty of care to users or third parties regarding the accuracy or completeness of information displayed on Compare.

 

10. Subscription, Payment, and Access

Access to Compare is provided under a subscription agreement between ORCHA and the Subscriber’s organisation. Subscriptions are subject to the fees, renewal periods, and user limits stated in the applicable Order Form. ORCHA may suspend access for non-payment or misuse.

 

11. Intellectual Property

All Intellectual Property Rights in Compare, its content, and underlying data remain the exclusive property of ORCHA or its licensors. Subscribers are granted a non-exclusive, non-transferable licence to use Compare internally for evaluation and procurement purposes only. Any external publication, redistribution, or reproduction requires prior written consent from ORCHA.

 

12. Limitation of Liability

To the fullest extent permitted by law, ORCHA shall not be liable for any indirect, consequential, or reliance losses arising from the use of Compare or any report. ORCHA shall have no liability for decisions, actions, or omissions made by you or third parties based on Compare data, including procurement or clinical choices. ORCHA’s total aggregate liability in connection with Compare shall be limited to the greater of: (a) the subscription fees paid to ORCHA in the preceding 12 months; or (b) £1,000.

ORCHA processes subscriber and user data in accordance with its Privacy Policy. Personal information provided when subscribing to Compare is used solely to administer access, deliver Compare updates and digests, and communicate material changes to the platform. Users may optionally opt in to receive wider ORCHA news or marketing communications at any time by managing their communication preferences.

ORCHA will process user data in accordance with its Privacy Policy (https://orchahealth.com/privacy-policy). Compare may record usage analytics and store data required for Watchlist or subscription management.

 

14. Termination and Suspension

ORCHA may suspend or terminate access to Compare where necessary for security, maintenance, or breach of these Terms. On termination, access to subscription data and reports will cease, and ORCHA will retain information only as required by law.

 

15. No Partnership or Agency

Nothing in these Terms creates any partnership, joint venture, or agency relationship between you and ORCHA.

 

16. Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
