Terms: Verify Watchlist

These Watchlist Terms (“Terms”) apply when you register to use the Watchlist feature within the ORCHA Verify platform (“Verify”). They supplement, and form part of, the Verify Terms of Use (“Verify Terms”). By activating or using the Watchlist, you agree to these Terms.

 

1. Service Description

1.1 The Watchlist allows registered users to follow selected Digital Health Products and receive notifications when ORCHA updates information about those products (for example, a change in ORCHA Assured status or a new assessment).
1.2 Notifications are provided by email or in-platform message. They are informational only and do not replace your own due-diligence or monitoring processes.

 

2. Accuracy and Availability

2.1 ORCHA will use reasonable endeavours to identify and notify significant product changes. However:
- not all updates may be detected or communicated;
- timing or frequency of alerts cannot be guaranteed; and
- technical or data delays may occur.
2.2 The Watchlist is provided on an “as is” basis without warranties of accuracy, completeness, timeliness, or continuous availability.

 

3. Limitations of Use

3.1 You may use Watchlist notifications only for personal or internal business purposes. You must not resell, redistribute, or misrepresent them as ORCHA advice or endorsement.
3.2 You must ensure your contact information remains accurate to continue receiving notifications.

 

4. Reliance and Liability

4.1 Notifications are provided for information only. They do not constitute certification, approval, or a guarantee of compliance.
4.2 ORCHA accepts no liability for any missed, delayed, or inaccurate notifications or for any loss, damage, or decision made in reliance on them.
4.3 ORCHA’s total aggregate liability in connection with the Watchlist shall be limited to £100.

 

5. Privacy and Data Protection

ORCHA will process personal data provided for the Verify Watchlist feature solely for the purpose of maintaining that service and communicating relevant alerts and updates to the user. Contact details will not be used for any other purpose without the user’s explicit consent.

5.1 Use of the Watchlist involves storing your selected products and contact details so that notifications can be delivered.
5.2 Your data will be processed in accordance with ORCHA’s Privacy Policy (https://orchahealth.com/privacy-policy). You may unsubscribe or delete your Watchlist at any time through your Verify account settings.

 

6. Suspension or Termination

6.1 ORCHA may suspend or terminate the Watchlist Service at any time for maintenance, security, legal, or operational reasons, or if you breach these Terms or the Verify Terms.
6.2 Upon termination, your stored Watchlist data will be deleted in accordance with ORCHA’s data-retention policy.

 

7. Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
