Terms of use: ORCHA Verify

These Terms of Use (“Terms”) govern your use of the ORCHA Verify platform (the “Platform”).
The Platform is operated by ORCHA Health Limited (“ORCHA”, “we”, “our”, “us”).
By accessing or using Verify, you agree to these Terms.

If you purchase a Compliance Report through Verify, your order is additionally governed by the Verify Compliance Report Terms of Sale and Use (“Compliance Report Terms”).

 

1. Interpretation

1.1 Capitalised terms used in these Terms have the meanings given in the ORCHA Standard Definitions Schedule (as updated from time to time and available at https://orchahealth.com/legal/definitions).
1.2 In the event of any conflict between these Terms and the Compliance Report Terms, the latter shall take precedence in relation to the sale and use of a Compliance Report.

 

2. About Verify

2.1 Verify is an informational transparency platform that enables users to view whether a Digital Health Product has been ORCHA Assessed or ORCHA Assured under one or more of the ORCHA Assessment Frameworks (such as the ORCHA Baseline Review (OBR) or OBR+).

2.2 Verify may also display related information, such as assessment dates, framework versions, assurance levels, and available badges.
2.3 Verify is provided for informational purposes only and does not constitute medical, clinical, legal, or regulatory advice.

 

3. ORCHA Assured and ORCHA Assessed

3.1 An ORCHA Assessed product has been evaluated by ORCHA under an Assessment Framework. This confirms only that an assessment has been completed; it does not indicate whether the product met or failed any particular standard.
3.2 An ORCHA Assured product has met the applicable criteria under the relevant Framework (for example, OBR or OBR+) and is subject to ongoing monitoring and re-assessment.
3.3 Neither designation implies regulatory approval, certification, or endorsement by ORCHA.

 

4. Accuracy and Reliance

4.1 ORCHA uses reasonable skill and care to ensure information shown on Verify is accurate and current, but information may change without notice.
4.2 Data is derived from publicly available sources and materials provided by product Developers or Suppliers.
4.3 Verify results are provided on an “as is” and “as available” basis without warranties or guarantees of completeness or timeliness.
4.4 Users must exercise their own professional judgment and due diligence before relying on any information obtained through Verify.

 

5. Watchlist Service

5.1 Registered users may subscribe to Verify’s Watchlist feature to receive notifications of updates to products they follow.
5.2 ORCHA will use reasonable endeavours to provide timely notifications of significant changes; however:

  • Not all changes may be detected or communicated; and
  • Notifications may be delayed or incomplete.
5.3 The Watchlist is an informational convenience service only. ORCHA provides no warranty that it will capture all changes or updates.
5.4 ORCHA accepts no liability for any missed, delayed, or inaccurate notifications, or for reliance placed upon them.
 

6. Use of the Platform

6.1 You may use Verify only for lawful purposes and in accordance with these Terms.

6.2 You must not:

  • attempt to copy, extract, or reverse engineer the Platform or its data;
  • misrepresent information obtained from Verify as your own analysis;
  • use Verify in a way that infringes any Intellectual Property Rights or data-protection laws.
6.3 ORCHA may suspend or terminate access to Verify or the Watchlist Service at any time for maintenance, legal, or operational reasons.

 

7. Ownership and Intellectual Property

7.1 All Intellectual Property Rights in Verify, its content, and related badges, names, or marks are owned by ORCHA or its licensors.
7.2 You may view and use Verify content for your personal or internal business purposes only.
7.3 Any other reproduction or redistribution requires prior written consent from ORCHA.

 

8. No Endorsement or Regulatory Equivalence

8.1 Information displayed on Verify does not constitute endorsement of any product or guarantee of compliance with any regulatory regime (including MHRA registration, UKCA, CE marking, or FDA clearance).
8.2 Verify is not a substitute for regulatory due diligence, and ORCHA disclaims any responsibility for determining whether a product is appropriately regulated or clinically safe for use.

 

9. Limitation of Liability

9.1 To the fullest extent permitted by law, ORCHA shall not be liable for any direct, indirect, or consequential losses or damages arising from the use of, or inability to use, Verify.
9.2 Verify is provided without warranties of any kind, including but not limited to accuracy, completeness, reliability, or fitness for purpose.
9.3 ORCHA’s total aggregate liability in connection with the use of Verify shall be limited to £100.

 

10. No Partnership or Agency

Nothing in these Terms shall create any partnership, joint venture, or agency relationship between you and ORCHA.

 

11. Privacy and Data Protection

ORCHA will process personal data provided for the Verify Watchlist feature solely for the purpose of maintaining that service and communicating relevant alerts and updates to the user. Contact details will not be used for any other purpose without the user’s explicit consent.
Your use of Verify is also governed by ORCHA’s Privacy Policy. By using the Platform, you consent to ORCHA’s processing of your information in accordance with that policy.

 

12. Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
